Kratom is legal in AZ today, but it wasn’t right after 2014. The state legislature only reconsidered its stance on the plant in 2019, leading to the establishment of the Kratom Consumer Protection Act (KCPA).

The Kratom Consumer Protection Act of 2019 legalized and regulated kratom purchases, distribution, and sales.

  • Vendors can’t sell contaminated and adulterated products or synthetic alkaloids. They can only stock 100% natural kratom.
  • Vendors must remove any dangerous, scheduled, or poisonous substances from kratom.
  • Vendors must not sell products with over 2% 7-hydroxymitragynine. They must label their products with precise percentages of both active substances.

If sellers don’t abide by these rules, they face a Class 2 misdemeanor. Consequences include four months in jail and a fine of up to $750.

Future predictions for kratom legality in Arizona

Kratom is legal in AZ and has become popular among consumers since it entered the market. As a result, the state legislature wanted to loosen the rules for sellers.

A republican representative proposed House Bill 2651 in February 2021. It sought to:

  • Replace the term dealer with retailer in the KCPA. This classification would be more accepting of legal sellers.
  • Prohibit financial institutions from refusing to do services for kratom vendors. Private banks can still refuse to do business with them.
  • Prohibit state agencies from seizing kratom products. Since kratom isn’t a federally controlled substance, each region should be free to determine its legality.

This bill died in the committee, so it’s not likely to return for a second vote. Nevertheless, it exhibits the willingness of leaders to encourage sellers to enter the market. The situation is looking up for Arizonians looking to use kratom.

Even though kratom is legal in The Grand Canyon State, representatives aren’t yet satisfied. Notably, former governor Matt Salmon is a vocal advocate for the American Kratom Association.

The AKA seeks to make the substance legal and regulated throughout the US. Their work aims to let every American have a choice about what they consume and ensure safety for all.
